Medical Management Associates Ask-A-Consultant: Implementing a Compliance Plan

Q:
My attorney tells me that I may be better
off not having a compliance program at all if I don’t intend to implement
the plan to the letter. However, everything that I read suggests that I
need to have a written compliance plan, but I really don’t want to add
any more administrative workload to my already overburdened office staff.
What do you think?
A:
Your attorney is giving you good advice. Having
a compliance plan and then ignoring its implementation actually may put
your practice at greater risk in the event of a compliance audit since
you clearly cannot argue ignorance of the law. However, we encourage all
of our clients to develop a written compliance plan, but to do so in a
manner which is reasonable and implementable.
